  • Controller or processor
    Controller or processor means the natural or legal person, authority, institution, or other body that alone or jointly with others determines the purposes and means of the processing of personal data. If the purposes and means of such processing are laid down by Union law or the law of the Member States, the controller or the specific criteria for their designation may be provided for by Union law or the law of the Member States.
  • Processor
    Processor means a natural or legal person, authority, institution, or other body that processes personal data on behalf of the controller.
  • Recipient
    Recipient means a natural or legal person, authority, institution, or other body to whom personal data is disclosed, regardless of whether it is a third party or not. However, authorities that may receive personal data in the course of a particular investigation under Union law or the law of the Member States do not count as recipients.
  • Third party
    Third party means a natural or legal person, authority, institution, or other body other than the data subject, the controller, the processor, and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data.
  • Consent
    Consent means any freely given, specific, informed, and unambiguous indication of the data subject's wishes, in the form of a statement or a clear affirmative action, by which the data subject signifies their agreement to the processing of personal data concerning them.

Routine deletion and blocking of personal data

    Jede von der Verarbeitung personenbezogener Daten betroffene Person hat das vom Europäischen Richtlinien- und Verordnungsgeber gewährte Recht, von dem Verantwortlichen zu verlangen, dass die sie betreffenden personenbezogenen Daten unverzüglich gelöscht werden, sofern einer der folgenden Gründe zutrifft und soweit die Verarbeitung nicht erforderlich ist:

  • Right to Data Portability

They also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, as long as the processing is based on consent in accordance with Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
    Furthermore, when exercising their right to data portability in accordance with Art. 20(1) GDPR, the data subject has the right to have personal data transmitted directly from one controller to another, where technically feasible and where this does not adversely affect the rights and freedoms of others.

  • Right to Object
    Every person affected by the processing of personal data has the right, granted by the European legislator, to object at any time to the processing of their personal data on grounds relating to their particular situation, when the processing is carried out pursuant to Art. 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions.
    We will no longer process the personal data in the event of an objection unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing is necessary for the establishment, exercise, or defense of legal claims.
    If we process personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning them for the purposes of such marketing. This also applies to profiling to the extent that it is related to such direct marketing. Privacy Policy for the Use and Implementation of Matomo

The data controller has integrated the Matomo component on this website. Matomo is an open-source software tool for web analysis. Web analysis is the collection, gathering, and evaluation of data about the behavior of visitors to websites. A web analysis tool captures data about which website a data subject came from (the so-called referrer), which subpages of the website were accessed, how often, and for what duration a subpage was viewed. Web analysis is primarily used to optimize a website and for cost-benefit analysis of online advertising.

The software is operated on the server of the data controller, and the log files, which are sensitive from a data protection perspective, are stored exclusively on this server.

The purpose of the Matomo component is to analyze visitor traffic on our website. The data and information obtained are used by the data controller, among other things, to evaluate the usage of this website and to compile online reports that display the activities on our websites.

Matomo places a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, we are enabled to analyze the usage of our website. Each time one of the individual pages of this website is accessed, the internet browser on the information technology system of the data subject is automatically prompted by the Matomo component to transmit data for online analysis to our server. As part of this technical process, we gain knowledge of personal data such as the IP address of the data subject, which helps us track the origin of visitors and clicks.

Legal basis of processing

Art. 6 I lit. a DS-GVO serves as the legal basis for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the fulfillment of a contract to which the data subject is a party, such as in processing operations necessary for the delivery of goods or the provision of other services or performances, the processing is based on Art. 6 I lit. b DS-GVO. The same applies to processing operations necessary for the execution of pre-contractual measures, such as in cases of inquiries about our products or services. If our company is subject to a legal obligation requiring the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c DS-GVO. In rare cases, processing of personal data may be necessary to protect vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were to be injured in our operation and their name, age, health insurance data, or other vital information needed to be disclosed to a doctor, a hospital, or other third parties. In this case, the processing would be based on Art. 6 I lit. d DS-GVO.

Duration for which personal data is stored

The criterion for the duration of storage of personal data is the respective statutory retention period. Upon expiration of this period, the corresponding data is routinely deleted, unless it is still required for contract fulfillment or pre-contractual measures.

Legal or contractual provisions for providing personal data; necessity for concluding the contract; obligation of the data subject to provide personal data; possible consequences of non-provision.

We inform you that the provision of personal data is partly required by law (e.g., tax regulations) or may result from contractual agreements (e.g., information about the contracting party).
In some cases, it may be necessary for a contract to be concluded that a data subject provides us with personal data that must subsequently be processed by us. For example, the data subject is obliged to provide us with personal data when our company enters into a contract with them. Failure to provide personal data would result in the inability to conclude the contract with the affected person.
